Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and ooddle ("ooddle", "we", "us", or "our") and govern your use of our website, mobile and web application, and related services (the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

ooddle is a personal wellness companion that delivers daily and weekly content, actions, and reflections built from preferences and signals you choose to share. The Service is provided for general informational and motivational purposes only. ooddle is not a healthcare provider, and the Service is not medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for any medical concern.

2. Eligibility

You must be at least 18 years old to create an account, or the age of majority in your jurisdiction if higher. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. Your account

You are responsible for keeping your account credentials confidential and for all activity that happens under your account. You agree to provide accurate information during sign-up, to keep your account information current, and to notify us promptly at support@ooddle.com if you suspect unauthorized access.

4. Subscriptions and billing

ooddle offers a free tier and paid subscription tiers. Paid plans renew automatically at the price and on the cycle disclosed at checkout, unless you cancel before the renewal date. You can manage or cancel your subscription at any time from Settings → Subscription. Cancellations take effect at the end of the then-current billing period; we do not provide partial refunds for unused time except where required by law.

Free trials, if offered, automatically convert to a paid subscription at the end of the trial period unless you cancel beforehand. We may change prices on renewal with reasonable advance notice; if you do not agree to the new price, you may cancel before it takes effect.

5. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in violation of any applicable law;
• reverse engineer, decompile, or extract the source code of the Service;
• scrape, copy, or republish content from the Service except for your own personal use;
• attempt to access another user's account or any part of the Service that is not made available to you;
• introduce malware, viruses, or any other harmful code;
• interfere with or disrupt the integrity or performance of the Service;
• use the Service to harass, abuse, or harm another person.

6. Your content

You retain ownership of the content you submit to the Service (notes, journal entries, chat messages, free-text answers). By submitting content you grant ooddle a worldwide, non-exclusive, royalty-free licence to host, store, transmit, and process it solely to operate and improve the Service for you. We do not use your content to train external base models.

7. AI-generated content

The Service uses third-party language models to draft personalized content. Generated content reflects the input given to the model; it can be inaccurate, incomplete, or unsuitable for your situation. Treat AI-generated suggestions as informational only — never as medical, legal, or financial advice. ooddle is not responsible for actions you take in reliance on AI-generated content.

8. Intellectual property

The Service, including its design, software, text, graphics, brand marks (including the ooddle name and logo), and underlying technology, is owned by ooddle and is protected by copyright, trademark, and other intellectual-property laws. We grant you a limited, revocable, non-transferable, non-exclusive licence to access and use the Service for personal, non-commercial purposes during the term of these Terms.

9. Third-party services and links

The Service may include links to or integrations with third-party websites or services. We do not control and are not responsible for those third parties. Your use of any third-party site or service is governed by that party's terms and privacy policy.

10. Termination

You may terminate these Terms at any time by deleting your account from Settings → Profile. We may suspend or terminate your access if you materially breach these Terms or if continued provision is not commercially reasonable. Sections that by their nature should survive (intellectual property, disclaimers, limitations, indemnity, dispute resolution) will survive termination.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. OODDLE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION GENERATED BY THE SERVICE IS ACCURATE OR APPROPRIATE FOR YOUR CIRCUMSTANCES.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OODDLE'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID OODDLE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100). OODDLE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13. Indemnity

You agree to defend, indemnify, and hold harmless ooddle, its officers, directors, employees, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

14. Governing law and disputes

These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally will be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of those courts.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top and, for material changes, give notice through the app or by email. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
